PATENTS:

A patent is a right granted by the United States government to an inventor. There are three types of patents available in the United States: (1) a utility patent, which covers the functional aspects of products and processes. A utility patent can be applied for as either a provisional patent application or a regular patent application; (2) a design patent, which covers the ornamental design; and (3) a plant patent, which covers a new variety of living plant. Each type of patent confers "the right to exclude others from making, using, offering for sale, or selling" the invention in the United States or importing the invention into the U.S. It is the right to exclude others that makes the patent so valuable to U.S. businesses.

If you have developed a new product, process (including software), manufacture, composition of matter, or new and useful improvement thereof, you may be able to exclude your competition from using the product, process, manufacture, or composition of matter, by securing a patent grant. However, the patent process is extremely complex, and the patent lawyer or law firm you choose for patent services will likely dictate the amount of protection you receive. Your business' protection depends on choosing experienced patent and trademark attorneys.

Paparella & Associates is an intellectual Property law firm (patent and trademark law firm) that specializes in protecting the intellectual property of your business. Our representation comprises: the preparation and filing of utility patent applications both the U.S., as well as internationally, including software patents and business method patents; the preparation and filing of provisional patents, as well as design patents; representation in patent infringement matters; patent opinion matters; and patent litigation, as well as numerous other patent and trademark services.

TRADEMARKS:

A trademark is a word, name, symbol (logo), device or any combination thereof which is used to identify and distinguish the goods or services of one business from another. A trademark application can be filed or registered using either a State or U.S. (U.S.P.T.O.) trademark application. There are three types of trademark protection available in the United States: (1) common law, which offers protection simply by using the trademark. This type of trademark does not require trademark registration (or application for registration); (2) a state trademark application, which typically requires the mark to be registered for protection; and (3) a U.S. trademark application, which also requires the mark to be registered for protection. A United States Registered Trademark allows the owner to prevent others from using the mark in a confusingly similar manner and/or business. It is the right to exclude others from using the trademark (logo or name) of your business that makes trademark registration so valuable to U.S. businesses and companies.

As such, if you have developed a brand, logo, name, or other "mark" which is associated with your particular business' goods or services, you may be able to exclude your competition from using your mark by seeking registering of the trademark. However, trademark registration can be extremely complex and the trademark lawyer or law firm you choose to represent you will likely dictate the amount of protection you receive. Your business' protection depends on choosing experienced patent and trademark attorneys.

Paparella & Associates is an intellectual Property law firm (trademark and patent law firm) that specializes in protecting all aspects of your business. Our representation includes: the preparation and filing of trademark applications for protection in every state, throughout the U.S., as well as throughout the world; representation in trademark infringement matters; trademark opinion matters; trademark litigation, as well as numerous other trademark and patent services.

In line with Google's 10th anniversary, the company is launching an initiative to find, review, and bankroll, novel ideas which it believes "will help and help most."

Called Project 10100 (pronounced 10 to the 100th), the project will seek input from the public and a panel of judges in choosing up to five ideas, and then backing them with up to 10 million dollars (total).

Google announced the project live on CNN.
